2022 Electoral Act: Supreme Court throw Out Buhari’s Case Against National Assembly

The contentious provision of the 2022 Electoral Act known as section 84 (12) was the subject of a legal challenge that was made against the National Assembly. However, the Supreme Court has decided to throw out the case.

After having given his approval to the Electoral Bill on February 25, 2022, the Supreme Court has decided that President Buhari does not have the authority to contest the legitimacy of the Electoral Act because he has already signed it into law.

The move that Buhari took in initiating the case has been seen to be an extreme misuse of the judicial system, according to a ruling that was just issued and was made by Justice Emmanuel Akomaye Agim.

According to the highest court in the land, the President’s lawsuit was an attempt to validate and invalidate his actions at the same time, which the court ruled cannot be permitted.

In addition, the court decided that Buhari did not have the authority under any law to instruct the National Assembly on how laws should be made.

It was decided by a unanimous jury that because Buhari had participated in the creation of the Electoral Act by giving his approval to it, he did not have the constitutional power to come forward and dispute it.
